Terms of service
These terms are an agreement between you and Health Council Inc. ("we"), which makes Frameotter. By creating an account or using the website, the web editor or the desktop app, you agree to them. Our privacy policy says how we handle your data.
Your account
You need to be at least 13 (and old enough to agree to these terms where you live) to use Frameotter. Keep your password to yourself; you're responsible for what happens in your account. Tell us at support@frameotter.com if you think someone else has used it.
The editor and the AI plans
The editor is free. The AI features (the assistant and clip analysis) use an allowance: a small one on the free plan, larger ones on the paid plans shown on our plans page.
Paid plans are billed through Stripe, monthly or yearly, in advance, and renew automatically until you cancel. You can cancel at any time from the plans page; your plan stays until the end of the period you've paid for. Unused allowance doesn't carry over. Except where the law says otherwise, payments aren't refundable; if you think we charged you by mistake, write to billing@frameotter.com.
We may change prices or plans; a change to your paid plan takes effect at your next renewal, after we've told you.
Your content
Your footage, projects and the videos you make are yours. You give us permission to store, process and send them to our service providers only as needed to run Frameotter for you (our privacy policy lists them), and for nothing else.
You're responsible for having the rights to what you edit and publish, including game footage, music and other people's work and likeness. Many game publishers have their own rules for videos of their games.
AI results
The assistant and clip analysis are made by AI and can be wrong: they can miss moments, mishear words or make edits you don't want. Check the result before you publish it. You own what the AI makes for you, as far as the law allows.
Using Frameotter fairly
Don't use Frameotter to break the law or anyone's rights, to make content that sexualises minors or that harasses, threatens or deceives people, to attack or overload our systems, to get around your plan's limits, or to resell the AI features. We may suspend or close an account that does.
Our software
Frameotter, its software, name and otter are ours (some parts are open-source software under their own licences, listed in the app). We give you a personal, non-transferable right to use it under these terms. The desktop app updates itself to stay compatible and secure.
Ending
You can stop using Frameotter at any time and ask us to delete your account. We may end or suspend your access if you break these terms, or stop offering Frameotter with reasonable notice; if we stop offering a paid plan you've paid for, we'll refund the unused part.
Disclaimers and liability
Frameotter is provided "as is". We work to keep it running and your projects safe, but we don't promise it will always be available or free of errors, so keep copies of your footage and the videos you make.
As far as the law allows, we're not liable for indirect or consequential losses (such as lost profits, views or data), and our total liability to you is limited to what you paid us in the 12 months before the claim, or $50 if more. Nothing here limits rights you have under consumer law that can't be limited.
General
These terms are governed by the laws of the State of Delaware, USA, apart from its conflict-of-law rules, unless the law where you live says otherwise. If we change them we'll update the date above and tell you in the app or by email if the change matters; continuing to use Frameotter after that means you accept them.
